Another common issue we deal with while helping physical therapists in New York is audits and exclusions by New York Office of Medicaid Inspector General (OMIG). OMIG is the agency responsible for running the Medicaid program in New York. They have the authority to conduct audits and investigations, refer cases to litigation and criminal prosecutions, and exclude practitioners from participating in Medicaid. OMIG cases maybe very complicated and we recommend seeking professional legal assistance before communicating with OMIG auditors and investigators. If an audit is not properly handled, you may be found to owe the state tens and hundreds of thousands of dollars. Your Medicaid payments may be withheld, and in some cases, OMIG may even refer your cases for further investigation by the Attorney General’s Office, which can lead to criminal charges. OMIG may also exclude any provider from Medicaid if they believe that the provider’s participation could endanger the program. This includes being arrested for a healthcare related fraud or being found guilty of professional misconduct. If you are excluded from Medicaid, your career as a physical therapist may be complicated by the fact that you can’t work in any facility that bill Medicaid.
